PLEASE READ THIS LEGAL WARNING AND CONDITIONS OF USE OF OUR WEBS CAREFULLY, SINCE BY USING THEM THE PERSON WHO ENTERS (“THE USER”) ACCEPTS SAID CONDITIONS. IF THE USER IS NOT IN AGREEMENT WITH THESE CONDITIONS, HE SHOULD NOT USE ANY WEB OF ALERCE SISTEMAS MULTIMEDIA.

1. LEGAL WARNING AND ITS ACCEPTANCE. The present Legal Warning regulates the use of the Services that SERCO ALERCE, S.L. (hereinafter “ALERCE SISTEMAS MULTIMEDIA”) with domicile in Avd. Blasco Ibáñez Nº 7, Bajo MANISES 46.940 (Valencia), C.I.F number B-46.297.719, and e-mail address alerceadmon@manises.com puts at the disposal of its Internet Users; the access to the different contents which it offers exclusively in the market through the design of its own web pages.
The use of any of the web pages of ALERCE SISTEMAS MULTIMEDIA or, if it exists, the sending of the registration form, attributes the condition of User of the web page or the Service (hereinafter “the User”) and implies the full and unreserved acceptance of each and every one of the dispositions included in this legal warning.
The use of certain Services offered to the Users through a website of ALERCE SISTEMAS MULTIMEDIA may be subject to particular personal conditions that, according to the case, substitute, complete and/or modify the present Legal Warning.

2. POLICY OF AUTOMATED TREATMENT OF PERSONAL DATA. To access some of the Services that ALERCE SISTEMAS MULTIMEDIA offers through its web pages, it is necessary to provide personal data. The department responsible for the files will be that of Information Systems of ALERCE SISTEMAS MULTIMEDIA. This consenting to the disclosure of data may be revoked in accordance with that laid down in the current legislation. ALERCE SISTEMAS MULTIMEDIA has adopted the legally required levels of security of protection of personal data, and has installed technical means and measures to avoid the loss, improper use, alteration, unauthorized access and theft of the personal data provided. ALERCE SISTEMAS MULTIMEDIA reserves the right to modify the present policy in order to adapt it to legislative and jurisprudential changes and demands, as well as to industry practices, bearing in mind at all times the legitimate interests of the User. Certain Services offered in the website may contain particular conditions with specific precautionary measures in the area of personal data protection.

The User guarantees that the personal data provided to ALERCE SISTEMAS MULTIMEDIA is true and is responsible for the communication of any modification in this, being the only party responsible for the false or inaccurate declarations made and for any damage which might be caused to ALERCE SISTEMAS MULTIMEDIA or to third parties by the information provided. ALERCE SISTEMAS MULTIMEDIA uses cookies when a User surfs its web pages. The cookies that may be used in the sites and websites of ALERCE SISTEMAS MULTIMEDIA are associated only with the navigator of a particular computer (an anonymous User) and do not provide in themselves the name and surname of the User.

3. CONDITIONS OF USE OF THE ALERCE SISTEMAS MULTIMEDIA WEBSERVICES.
The User commits himself to using the website and the Services in conformity with the law, the present Legal Warning, the Particular Conditions of some Services, and with morality, generally accepted good customs, and public order.

* Is in contra to or attempts against the fundamental rights and the public liberties recognized constitutionally, or in the rest of the legislation.
* is in contra to the right to honour, personal and family privacy or the image of the people themselves.
* constitutes illicit, deceptive or disloyal publicity and, in any way, constitutes disloyal competition.
* incorporates viruses or other physical or electronic elements that can damage or prevent the normal operation of the network, the system or of computer systems (hardware and software) of ALERCE SISTEMAS MULTIMEDIA or of third parties, or that can damage electronic documents and archives stored in these computer systems.
* causes difficulties in the normal operation of the Service.
* incites, induces or promotes acts which are criminal, denigratory, slanderous, violent or against the law, morality, good customs and public order.
* incites, induces or promotes discriminatory acts or attitudes due to sex, race, religion, beliefs, age or condition.
* makes available, incorporates, or permits access to products, elements, messages and/or Services that are criminal, violent, offensive or against the law, morality, good customs or public order.
* is protected by intellectual or industrial property rights belonging to third parties without the User having previously obtained from their holders the necessary authorisation to carry out the use he is making or intends to make.
* violates the business rights of third parties.

4. CONTENTS GATHERED ON THE WEB. Any User placing information on any website of ALERCE SISTEMAS MULTIMEDIA in the form of a web page or in any other way which allows access by third parties will not for this reason become a collaborator of ALERCE SISTEMAS MULTIMEDIA, but rather will be a divulger or independent editor of contents. The function of the links that appear on the page is exclusively that of informing the User of the existence of other sources of information on the subject on Internet. Said links do not constitute a suggestion, invitation or recommendation to visit the destinations, and as such, ALERCE SISTEMAS MULTIMEDIA will not be responsible for the result obtained through these hypertextual links.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY. All of the elements making up the graphic design of the websites, the menus, the navigation buttons, the HTML code and, in general, all of the contents and information to which the User may access through the web pages of ALERCE SISTEMAS MULTIMEDIA are subject to industrial and intellectual property rights, patents, brands or copyright of ALERCE SISTEMAS MULTIMEDIA or of third parties holders of the same. The alteration, modification, exploitation, reproduction, distribution, public communication or any other right corresponding to the holder of the affected right is expressly prohibited for the User. In the same way, ALERCE SISTEMAS MULTIMEDIA reserves its own intellectual property rights over the web pages, multimedia works, on-line databases and other programmes which it may offer to its Users for the Services contracted; the contents, availability, ordering, development and updating of the same belong exclusively to ALERCE SISTEMAS MULTIMEDIA.

6. USE OF THE WEBSITE UNDER THE EXCLUSIVE RESPONSIBILITY OF THE USER. The User recognizes and accepts that the use of the website and of the Service rendered takes place, in any case, under his sole and exclusive responsibility.
The User is the only responsible party in the face of any possible reclamation or legal, juridical or extra-juridical action initiated by third parties, equally against the User as against ALERCE SISTEMAS MULTIMEDIA, based on the use by the User of the Service, with this party assuming the expenses, costs and indemnities caused to ALERCE SISTEMAS MULTIMEDIA with the motive of such reclamations or legal actions.

7. EXCLUSION OF GUARANTEES AND RESPONSIBILITIES. ALERCE SISTEMAS MULTIMEDIA does not guarantee the availability and continuity of the operation of the Service, nor its usefulness for the performance of any activity in particular, nor its infallibility and quality and, in particular, although not exclusively, that the Users may access the Service effectively, create, install, eliminate, manage or run any of the foreseen features.
ALERCE SISTEMAS MULTIMEDIA excludes any responsibility for loss and damage of any kind that may be due to the lack of availability, continuity or quality of operation of the Service, the disappointment at the usefulness the Users may have attributed to the Service, and to the errors in the Service, and in particular, but not exclusively, to the errors in the access to the different websites of ALERCE SISTEMAS MULTIMEDIA from which the Services are rendered.
ALERCE SISTEMAS MULTIMEDIA is under no obligation to control, and does not control, the legality, trustworthiness, usefulness, truth, exactness, exhaustivity and actuality of the contents that the Users store in and diffuse from their personal pages; thus, beyond the control of ALERCE SISTEMAS MULTIMEDIA, are to be found the programmes of texts and data of the Users, unmoderated newsgroups of the server itself; newsgroups of other servers, chats, distribution lists and FTP accounts.
ALERCE SISTEMAS MULTIMEDIA excludes any responsibility for loss and damage of any kind that may be due to the presence of viruses or of other elements in the contents which may produce modifications in the computer system, electronic documents or archives of the Users.
ALERCE SISTEMAS MULTIMEDIA Assumes no responsibility for the damage which the information deposited by the Users in ALERCE SISTEMAS MULTIMEDIA websites may cause to other Users.
ALERCE SISTEMAS MULTIMEDIA excludes any responsibility for loss and damage of any kind which may be produced by the Users in the transmission, diffusion, storage, making available, reception, obtention or access to the contents and in particular, although not exclusively, for the loss and damage that may be due to:
* the non-compliance with the law, morality or generally accepted good customs or public order as a consequence of the transmission, diffusion, storage, making available, reception, obtention or access to the contents
* the infraction of the intellectual or industrial property rights, of company secrets, of contractual commitments of any kind, of the right to honour, to personal and family privacy and the image of the people, of property rights and of any other kind belonging to a third party as a consequence of the transmission, diffusion, storage, making available, reception, obtention or access to the contents.
* the performance of acts of disloyal competition and illicit publicity as a consequence of the transmission, diffusion, storage, making available, reception, obtention or access to the contents.
* lack of truth, exactness, exhaustivity, ownership and/or actuality of the contents
* the supplanting of the personality of a third party carried out by a User in any kind of communication performed through the Service
* the non-compliance, delay in the compliance, defective compliance or the termination for any reason of the obligations contracted by third parties and contracts drawn up with third parties through or with the motive of access to the contents.
* the imperfections and defects of any kind of the contents transmitted, diffused, stored, made available or in any other way transmitted or made available, received, obtained, or which may have been accessed through the Services

8. UPDATING OF THE WEBS. ALERCE SISTEMAS MULTIMEDIA reserves the right to update, modify or eliminate the information contained in its websites, being able even to limit or forbid access to said information. The information contained in the web pages of ALERCE SISTEMAS MULTIMEDIA is that valid at the date of their last update, and as such they belong to ALERCE SISTEMAS MULTIMEDIA as author’s rights of a collective work.

9. LICENCE. ALERCE SISTEMAS MULTIMEDIA authorizes to the User the use of the computer applications that run the features that make up the Service solely to use the Service in agreement with what is established in the present Legal Warning. ALERCE SISTEMAS MULTIMEDIA does not concede any other licence or authorization for use of any kind for said computer applications, nor for any other industrial or intellectual property right or any other property or right related with the Service.

10. DURATION AND TERMINATION. The rendering of the Services and contents of the web pages of ALERCE SISTEMAS MULTIMEDIA are of indefinite duration. Without prejudice to the previous, ALERCE SISTEMAS MULTIMEDIA has the capacity to terminate, suspend or interrupt unilaterally the rendering of any of the Services, without prejudice to what may have been provided, in the case, in the corresponding particular conditions

11. APPLICABLE LEGISLATION. The present Legal Warning conforms to the Spanish Law in each and every one of its points.
